1. About This Platform
Welcome to Maravilla Resort (“Platform,” “we,” “our,” or “us”). This Platform is an informational listing directory whose sole purpose is to connect prospective guests with independent vacation rental hosts at Maravilla Resort, located at 2606 Scenic Gulf Dr, Miramar Beach, FL 32550.
The Platform does not own, manage, operate, or control any listed unit. The Platform does not facilitate, process, or handle any booking, reservation, payment, or financial transaction between guests and hosts. All such activity occurs exclusively between the guest and the individual unit host through channels entirely outside our control.
By accessing or using the Platform, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Platform.
2. Platform Role and Limitations
The Platform functions solely as an informational directory. We are not a party to any rental agreement, booking transaction, or financial arrangement between guests and hosts. We have no involvement in, and accept no responsibility for:
- (a) the accuracy, completeness, or truthfulness of any listing content;
- (b) the outcome of any booking inquiry or reservation;
- (c) any payment, deposit, refund, or financial dispute;
- (d) the condition, safety, or suitability of any listed unit; or
- (e) any experience, incident, or outcome occurring before, during, or after a guest's stay.
All listing content — including descriptions, photographs, pricing, availability, amenities, and contact information — is submitted exclusively by unit hosts and remains their sole responsibility.
3. Host Responsibilities
3.1 Listing Content
Hosts are solely responsible for all content they submit to the Platform, including unit descriptions, photographs, pricing, availability, amenity listings, and contact details. Hosts represent and warrant that all submitted information is accurate, current, truthful, and not misleading.
3.2 Legal Compliance
Hosts are solely responsible for complying with all applicable federal, state, and local laws, regulations, ordinances, and HOA rules governing short-term vacation rentals, including licensing, taxation, safety codes, and insurance requirements.
3.3 Guest Transactions
All communications, agreements, bookings, payments, cancellations, refunds, and disputes between hosts and guests are exclusively between those parties. The Platform has no role in, and assumes no liability for, any aspect of these transactions.
3.4 Indemnification
Hosts agree to indemnify, defend, and hold harmless the Platform, its operators, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to (a) their listing content, (b) their interactions with guests, or (c) their operation of a rental unit.
4. Guest Responsibilities
4.1 Use of the Platform
Guest use of the Platform is limited to browsing listing information and contacting unit hosts through the contact details provided. Guests agree to use the Platform lawfully and in accordance with these Terms.
4.2 Due Diligence
Guests acknowledge and agree that the Platform does not verify, endorse, or guarantee any listing content. Guests are solely responsible for conducting their own due diligence before entering into any agreement with a unit host. Any booking, payment, or rental arrangement is exclusively between the guest and the unit host.
4.3 Compliance
Guests who book a unit through a host are responsible for complying with all resort rules, local ordinances, HOA regulations, and any specific terms set by the unit host, including occupancy limits, quiet hours, parking restrictions, and property care requirements.
5. Disclaimer of Liability
To the fullest extent permitted by applicable law, the Platform, its owners, operators, directors, site developers, employees, and agents expressly disclaim all liability of any kind arising from or related to:
- (a) any inaccuracy, omission, or misrepresentation in listing content;
- (b) any booking transaction, payment dispute, or financial loss;
- (c) any injury, illness, property damage, theft, or loss occurring before, during, or after a stay;
- (d) any failure by a host to honor a reservation or fulfill their obligations;
- (e) any dispute between a guest and a host; or
- (f) any third-party platform, payment processor, or service used by a host.
The Platform provides no warranties, express or implied, regarding any listing, host, or rental unit. Use of the Platform and reliance on any listing information is entirely at your own risk.
5.1 No Association Affiliation or Involvement
Neither Maravilla Master Association, Inc., Maravilla Homeowners Association, Inc., nor Maravilla Condominium Association, Inc., individually, jointly, collectively, or in any capacity, owns or holds any ownership interest in, or exercises any management, supervisory, editorial, or operational involvement or control over, this Platform or the representations, content, and/or services provided through this Platform. The foregoing associations bear no responsibility or liability whatsoever for the operation of the Platform, the accuracy of any listing or representation made herein, or the conduct of any host, guest, or third-party service provider. Any use of the “Maravilla” name on this Platform is solely for geographic reference and does not imply endorsement, sponsorship, or affiliation by any of the aforementioned associations. Additionally, no website developer, contractor, or technology provider involved in the creation, hosting, or maintenance of this Platform holds any ownership interest in, or assumes any liability for, the representations, listings, or services offered through the Platform.
6. Third-Party Platforms and Payments
All bookings and payments are processed through third-party platforms and services selected independently by individual unit hosts. The Platform has no affiliation with, control over, or responsibility for any third-party booking platform, payment processor, or financial service. Guests should independently review the terms, policies, and protections of any third-party platform or service they use.
7. Indemnification
You agree to indemnify, defend, and hold harmless the Platform, its operators, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to (a) your use of the Platform; (b) your violation of these Terms; (c) any transaction or dispute between you and a unit host; or (d) any third-party claim related to your use of the Platform or a listed unit.
8. Intellectual Property
All website design, branding, graphics, logos, and original content created by the Platform are protected by copyright and applicable intellectual property laws. Listing content remains the intellectual property of the respective unit hosts. No content from the Platform may be reproduced, distributed, or commercially exploited without express written permission from the applicable rights holder.
9. Privacy
Your use of the Platform is subject to our Privacy Policy, which governs how we collect, use, and handle any information you provide. We encourage you to review the Privacy Policy before using the Platform.
10. Modifications
We reserve the right to update or modify these Terms at any time without prior notice. Changes take effect immediately upon posting. Continued use of the Platform following any modification constitutes your acceptance of the updated Terms.
11. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Walton County, Florida.
